The Process of Investigation™ Version 2.0 Overview
In this action packed two day course attendees will learn how to use the Process of Investigation™ to conduct legally defensible investigations. Version 2.0 examines new methods, phases, and legal aspects of corporate investigations. Potential ramifications will also be examined through new practical exercises and case studies.

Investigative interviewing tips will be revealed and attendees will learn how to obtain written or oral admissions. Anyone who might be involved with investigations should attend this training so they will be ready to conduct the most ethical and effective investigations possible!

Course Outline

Day 1
The Fundamentals of Fact-finding
Review in detail the five elements of a successful investigation and the proper methods of evidence handling and management. Examine the attributes of a successful fact-finder and learn how to document, catalog, and properly report findings. Properly discuss the terminology common to those who conduct private sector investigations as well as the qualifications of a professional investigator/fact-finder.

The Methods of Investigation
Closely examine six methods of investigation and learn how they are best used. Discover the most common means by which workplace offenses are discovered and investigations initiated. Increase your awareness of the legal complexities and risks associated with workplace investigations.

The Process of Investigation
Discuss the seven phases of investigation and what they include. Learn the importance of an investigations policy and how to prepare a proper report when necessary. Learn how to efficiently and fairly make credibility determinations.

Day 2
Investigative Interviews and Report Writing
Discover the essential components of a proper investigatory interview and learn how to consistently obtain written or oral admissions from those you interview. Examine the role of the project team and each member's responsibility. Learn how to properly take notes and write professional reports. Strengthen your interviewing skills and learn how to overcome denials and encourage reluctant interviewees to provide information. Learn how and when to conduct administrative interviews.

Legal Aspects and Ethics
Discuss the legal liabilities that may arise from workplace investigations and learn how avoid the legal traps created by today's courts, arbitrators and the EEOC. Learn the origin of case law and identify several important cases which affect the investigator and the interview process. Determine the difference between ethical and unethical investigator conduct. Most importantly—learn how to avoid litigation and liability through the use of better processes and proper planning.



Continuing Education Credits
This training has 14 approved HRCI credits. Credits can often be transferred to additional associations and organizations for certification.

Steven Foster, CPP, PCI - President
Mr. Foster’s 25 years of unique and diversified executive and operational leadership experience combines enterprise Governance, Risk & Compliance expertise, and expert knowledge regarding convergence of security and technology, as well as top level consulting and training in EEO/Internal Controls matters. Mr. Foster’s expertise is rooted in developing integrated SaaS technology solutions in the Governance, Risk and Compliance space. Mr. Foster frequently lectures across the country on the topics related to risk management, ethics and corporate compliance, conducting ethical workplace investigations, fraud, workplace violence, and the convergence of technology and security. He is a recognized Federal Court Expert Witness in the areas of Security Assessment, Analysis and Implementation.

Ricky Bennett, Vice President of Professional Services
Mr. Bennett leads the consultative and investigative divisions of Business Controls, Inc. Mr. Bennett’s areas of expertise include workplace misconduct investigations with EEO, sexual harassment, harassment, and discrimination in a myriad of employment settings. As a past CEO of a large law enforcement organization, Mr. Bennett is adept in analyzing corporate policies and developing preventative solutions to strengthen internal controls in the workplace. Autumn L. Lowry, M.A., Forensic Psychology
Autumn Lowry is the Manager of the Professional Services team and is a Behavioral Sciences Specialist for Business Controls, Inc. Ms. Lowry has managed numerous Workplace Violence Threat Assessments and corporate investigations in a variety of employment settings across all industry sectors. Further, she has conducted training for both corporate executives, and their employees, on topics such as workplace violence, sexual harassment, and the Process of Workplace Investigations.

Currently, Ms. Lowry oversees employee training with several large restaurant chains on I-9 compliance and wage and hour regulations. Ms. Lowry obtained her Bachelor’s of Science Degree in Psychology, with a Minor in Criminal Justice, from Illinois State University in Normal, Illinois. Further, she completed her Master of Arts Degree in Forensic Psychology from the University of Denver in Denver, Colorado.



Cancellations
If cancellation occurs at least 10 days in advance of the training date, the registration fee (less a $75 administrative fee) will be refunded. Refunds will not be granted for cancellations occurring less than 10 days from the training date. The registration fee for those requested less than 10 days of training may be applied to another training hosted by BCI. Substitution of attendees can be made at any time.
